Conditions of Sale

I. Application of the General Terms and Conditions of Sale (GTCS)

The present conditions apply exclusively to mail-order sales of wines and other products offered by SCEA ALAIN MOUEIX through our Club membership. Unless expressly agreed upon in writing between the Parties, such as in commercial offers from SCEA ALAIN MOUEIX, orders are automatically subject to the present general conditions of sale, regardless of any other clauses that may appear on documents completed by the Customer. 

II. Purchase

SCEA ALAIN MOUEIX reserves the right to refuse the benefits of its offers to any individual or legal entity proven to be or represent a professional reseller. SCEA ALAIN MOUEIX reserves the right to cancel or refuse any order from a customer with a dispute concerning a previous order. Offers are valid within the time limits and are subject to stock availability.

The quantities suggested by default in the shopping cart can be modified. However, to minimize the risk of breakage during transport, it is recommended to group these products in batches of six (6) bottles or multiples of twelve (12) bottles.

Please be aware that products are available in limited stock, and special offers are confidential and time-limited.

All orders will only be validated and accepted upon full and simultaneous payment.

III. Prices

Our prices are quoted and include all taxes, except for Vins Primeurs (also known as Bordeaux Futures), and are applicable in mainland France. These prices are valid during the period mentioned in our commercial offers or quotations. Products will be invoiced based on the current price list at the time the order is placed.

IV. Terms of Payment

When Customers pay for their orders on the website, SCEA ALAIN MOUEIX does not have access to their bank details. Payment is made directly to the bank’s electronic payment solution, which is the Société Générale Sogecommerce solution. Payment is made in full by credit card (Carte Bleue, Visa, Mastercard), and the purchase is debited immediately.

If a payment is declined, the Customer should contact their bank to ensure that their financial accounts function correctly. SCEA ALAIN MOUEIX cannot be held responsible in this situation.

In the event of non-payment or rejection of payment, the Customer is responsible for late payment interest equal to one and a half times the legal interest rate, in addition to the principal amount due.

Our products will remain our property until we have received full payment.

V. Delivery and Acceptance

Products are delivered to the address indicated by the Customer. In the event of a change of address, the Customer is requested to notify SCEA ALAIN MOUEIX.

Delivery of your parcel to the same address. The products on the e-commerce site can only be delivered to the countries indicated on the Club. We will provide a postage cost quotation for all other deliveries that must be approved before dispatch.

Standard delivery service. Delivery will take place within 8 to 10 working days of receiving the order.

Orders are dispatched Monday to Friday, except on public holidays and days when SCEA ALAIN MOUEIX is closed. Orders placed on weekends, public holidays, or closed days are processed on the next working day.

VI. Substitution

Some wines are quickly gaining popularity, causing stock shortages. We may need to provide a substitute wine of equal quality and price to ensure customer satisfaction. If this is not possible, we will issue a refund.

VII. Right of Return

In accordance with Article L221-18 of the French Consumer Code, Customers have the right to withdraw from their purchase within 14 days of receiving the order. The deadline is extended to the next working day if the 14-day period ends on a Saturday, Sunday, or public holiday. To exercise this right, Customers must return the products within the aforementioned period in their original, new, and undamaged condition.

  • Return shipping costs will be borne exclusively by the Customer.
  • The exchange (subject to availability) or refund will be processed within a maximum of thirty (30) days from the date of the Customer’s request.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g., a letter sent by post, fax, or e-mail) to Château Fonroque, 33 330 Saint Emilion or by e-mail to: wineclub@chateaufonroque.com

Dear Sir/Madam,

I, the undersigned … (state your full name) acknowledge that I ordered on … (indicate the date on the order form) the … (product description), which I received on … (date).

I hereby exercise my right of withdrawal in accordance with Article L. 221-18 of the French Consumer Code.

Consequently, I kindly request the return of the sum of … euros that I paid for my order within 14 days of receipt of this letter, in compliance with Article L. 221-24 of the French Consumer Code. Thank you in advance.

VIII. Personal Data

Under Article 27 of the French Data Protection Act no. 78-17 of 6 January 1978, Customers have the right to access, modify, rectify, and delete data concerning them. Customers must visit their accounts and modify their information to exercise this right. The Customer may also exercise this right:

The information collected on our website may only be shared externally with the Customer’s prior consent. It may also be shared to meet legal and regulatory obligations.

IX. Protection of Minors

Ordinance n°59-107 of 7 January 1959, Law n°74-631 of 5 July 1974, and Article L.3353- 3 of the French public health code prohibit the sale of alcohol to minors. Any Customer ordering wine from SCEA ALAIN MOUEIX undertakes to be at least 18 on the date of the order.

X. Copyrights

According to French Law no. 98-536 of 1 July 1998, transposing directive 96/9/CE of 11 March 1996 concerning the legal protection of databases, SCEA ALAIN MOUEIX is the owner of all or part of the databases making up the present website. All data on this site (text, images, graphics, logos, icons) are protected by copyright and may not be used on other external media without our explicit consent.

XII. Liability and Applicable law

SCEA ALAIN MOUEIX reminds you that the abuse of alcohol is dangerous for your health and that it is not responsible for the consequences of its consumption. These general terms and conditions of sale are governed by French law. Contractual information is presented in French. In the event of a dispute, the customer should first contact the Customer Service Department of SCEA ALAIN MOUEIX to find an amicable solution. Should negotiations fail, the court of the registered office of SCEA ALAIN MOUEIX will have sole jurisdiction for any dispute arising from the application of the present general conditions of sale, without excluding any referral by SCEA ALAIN MOUEIX to another competent court.
